Introduction to the Terms of Use:
Our online store welcomes you and informs you that below you will find the terms and conditions governing your use of this Store, as well as all legal consequences arising from your use of the Store’s services through the internet via this electronic platform. Any person’s use of the Store, whether as a consumer of a service or product offered by the Store or otherwise, constitutes their acknowledgment and acceptance, while having full legal capacity under Sharia, applicable regulations, and law, of all provisions and terms of this Agreement, and confirms their commitment to comply with its rules and provisions. This Agreement applies to all types of transactions between the consumer and the Store. This Agreement shall become valid and effective upon your acceptance thereof and commencement of registration with the Store, pursuant to Article Ten of the Saudi Electronic Transactions Law.
Article One – Introduction and Definitions:
The foregoing introduction shall constitute an integral part of this Agreement. The following terms and expressions used in this Agreement shall have the meanings set out below:
- (Store): This definition includes all forms of the Store available through the internet, whether an electronic application, a website, or a physical retail store.
- (Consumer): A person who engages in electronic commerce for the purpose of obtaining products or services offered by the Store through its electronic platform.
- (Agreement): This term refers to the terms and conditions of this Agreement, which govern and regulate the relationship between the parties to this Agreement.
Article Two – Legal Capacity of the Consumer:
- The Consumer acknowledges that they possess the legal capacity required under Sharia and applicable regulations to transact with the Store, or that they are at least eighteen years of age.
- The Consumer agrees that, in the event of any violation of this Article, they shall bear the consequences of such violation vis-à-vis third parties.
Article Three – Nature of the Obligation:
- The Store’s obligation toward consumers is to provide the relevant service or product.
- The Store may provide additional services, such as after-sales services or other related services, depending on the nature and type of service or product requested by the Consumer.
Article Four – Conditions of Use:
- The Consumer shall use the Store’s electronic platform in a manner consistent with public morals and the laws and regulations applicable in the Kingdom of Saudi Arabia.
- When purchasing a service or product from the Store, the Consumer shall not use such service or product in any manner that violates public morals or the laws and regulations applicable in the Kingdom of Saudi Arabia.
Article Five – Accounts and Registration Obligations:
Upon applying for membership in the Store as a user, you shall be required to disclose certain information and select a username and confidential password for use when accessing the Store’s services. By doing so, you agree to the following:
- You shall be responsible for maintaining the confidentiality of your account information and password, and you agree to immediately notify the Store of any unauthorized use of your account information or any other breach involving your confidential information.
- Under no circumstances shall the Store be liable for any loss incurred by you, whether directly or indirectly, morally or financially, as a result of disclosure of the Consumer’s username or password.
- You undertake to use your account or membership with the Store personally, and you shall bear full responsibility for it. If another person uses your account, this shall be deemed evidence that you have authorized such person to use the Store in your name and on your behalf.
- You undertake to use the Store seriously and in good faith.
- You undertake to provide true, accurate, current, complete, and lawful information about yourself as required during registration with the Store, and to update such information whenever it changes or whenever necessary.
- Our Store undertakes to treat your personal information and contact details with complete confidentiality.
- If the Store determines that you have provided information that is false, inaccurate, outdated, incomplete, unlawful, or otherwise contrary to this Terms of Use Agreement, the Store shall have the right to suspend, freeze, or cancel your membership, Store account, or account on the platform, without prejudice to any other rights of the Store or any lawful means available to it to recover its rights and protect other consumers.
- In the event of failure to comply with any of the foregoing, the Store management shall have the right to suspend or cancel your Store account or membership or prevent you from accessing the Store’s services again.
Article Six – Electronic Communications and Official Means of Communication:
- The parties to this Agreement agree that communication shall take place through the email address registered on the platform.
- The Consumer agrees that all agreements, notices, statements, and other communications provided electronically shall have the same legal effect as their written counterparts and shall constitute independent evidence for the purpose of satisfying applicable legal and Sharia requirements.
- The Consumer agrees that the Store may contact them and notify them of any provisions relating to this Agreement or their dealings with the Store by means of general messages sent by the Store management to all consumers or to specific Store users.
Article Seven – Amendments to the Terms of Use and Fees:
- If any article or provision of this Agreement is cancelled or ceases to be enforceable, such cancellation or unenforceability shall not affect the validity of the remaining articles, provisions, rules, and terms of this Agreement, which shall remain in force until further notice from the Store management.
- This Agreement, as amended from time to time as circumstances may require, constitutes the operating framework, understanding, and agreement between the Consumer and the Store.
- The Store may impose fees on certain consumers depending on the offers, products, or services requested by them, or any fees or taxes imposed by the government based on the nature of the product or service.
- The Store reserves the right to add, increase, reduce, or deduct any fees or expenses pursuant to the articles, provisions, and terms of this Terms of Use Agreement in respect of any Consumer, regardless of the reason for their registration.
Article Eight – Payment and Settlement Services:
- Through its partners, the Store provides payment and settlement services. Payments may be completed entirely online through the payment options available on the Store or through any other payment method made available by the Store from time to time.
- The Store shall determine the price of any service or product offered through the Store in accordance with generally accepted market value.
- The Store shall provide invoices, payment receipts, and acknowledgment receipts for all amounts and revenues generated through the Store and shall provide the Consumer with an invoice for the purchase of any service or product.
- The Store shall comply with generally accepted accounting standards in its electronic store, in accordance with the provisions of this Agreement and in furtherance of the legal, economic, commercial, and regulatory interests served by such compliance.
Article Nine – Intellectual Property:
- All intellectual property rights relating to the Store are wholly owned by the Store, whether such rights existed prior to the establishment of this electronic platform or were acquired thereafter.
- The Consumer shall respect the Store’s intellectual property rights, including the Store’s name, wording, trademarks, logos, symbols, and any other materials belonging to or displayed by the Store. All rights associated with the Store’s name are the exclusive intellectual property of the Store.
Article Ten – Store Liability:
- The Store undertakes to conduct its commercial activities through this electronic platform lawfully and in accordance with the laws and regulations applicable in the Kingdom of Saudi Arabia and the provisions of this Agreement.
- The Store shall not be liable for any claims arising from errors or negligence, whether arising directly, indirectly, incidentally, through the Consumer, or through a third party such as shipping companies.
- The Store, its personnel, owners, and representatives undertake that the product or service shall be lawful, permitted, and compliant with the laws and regulations of the Kingdom of Saudi Arabia and shall be used for lawful purposes.
Article Eleven – Restriction of Access or Membership:
The Store may suspend or cancel the Consumer’s membership or restrict the Consumer’s access to the platform’s services at any time, without prior notice and for any reason whatsoever.
Article Twelve – Governing Law:
This Terms of Use Agreement is governed by and construed in accordance with the laws, regulations, and legislation applicable and in force in the Kingdom of Saudi Arabia and shall be fully subject to the applicable laws and regulations enforced by the competent authorities in the Kingdom of Saudi Arabia.
Article Thirteen – General Provisions:
If any article or provision of this Terms of Use Agreement is cancelled or ceases to be enforceable, such cancellation or unenforceability shall not affect the validity of the remaining articles, provisions, and terms of this Terms of Use Agreement, which shall remain in force until further notice from the Store management.
This Terms of Use Agreement, as amended from time to time as circumstances may require, constitutes the terms of use, operating framework, understanding, agreement, and contractual relationship between the Store and the Consumer. Both parties to this Agreement further agree that the following shall apply:
- The Arabic language shall be the authoritative language for the interpretation of the provisions of this Agreement or in the event that it is translated into another language.
- All prices displayed for the Store’s services or products may be amended from time to time.
- Any promotional or marketing offers made available by the Store shall be temporary, and the Store shall have the right to amend or discontinue such promotional or marketing offers at any time.
- The parties to this Agreement shall conduct their dealings with one another in a manner that does not violate Sharia principles or the applicable laws and regulations relevant to the nature of the relationship between the Store and the Consumer.
- This Terms of Use Agreement may only be terminated pursuant to a decision issued by the Store management.
